Terms of service

OVERVIEW

This website is operated by Hemstock’s Jewellers. Throughout the site, the terms “we”, “us” and “our” refer to Hemstock’s Jewellers. We provide this website, including all information, tools and services available from it, to you conditional upon your acceptance of these Terms of Service.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service, including any additional policies referenced here or available by hyperlink. These Terms apply to all users of the site.

Please read these Terms of Service carefully before using our website. If you do not agree with them, you must not use the website or purchase from us. Nothing in these Terms affects your statutory rights.

We may update these Terms from time to time. Any changes will apply only to future orders and will not affect orders already placed.

Our store is hosted by Shopify Inc., who provide the e‑commerce platform that enables us to sell our products and services to you.

1. ONLINE STORE TERMS

By agreeing to these Terms, you confirm that you are at least 18 years old, or that you are using the site with the consent of a parent or guardian.

You must not use our products for any unlawful purpose or violate any applicable UK laws. You must not transmit any harmful code, viruses or malware.

A breach of these Terms may result in termination of your access to the Service where legally permitted.

2. GENERAL CONDITIONS

We may refuse service where legally permitted, for example in cases of suspected fraud, misuse, or breach of these Terms.

You understand that your content (excluding payment information) may be transferred unencrypted across networks. Payment information is always encrypted during transfer.

You agree not to reproduce, duplicate, copy, sell or exploit any part of the Service without our written permission.

3. ACCURACY OF INFORMATION

We take reasonable care to ensure product descriptions, pricing and availability information are accurate. If we discover an error, we will correct it and contact you if it affects an order you have placed.

General website content is provided for information only and may not always be fully up to date.

4. MODIFICATIONS TO THE SERVICE AND PRICES

Prices may change from time to time. Changes will not affect orders already placed.

We may modify or discontinue parts of the website for maintenance or updates. We will try to give reasonable notice where possible.

5. PRODUCTS AND SERVICES

Some products may be available exclusively online and may have limited quantities. Returns and exchanges are governed by our Returns Policy and your statutory rights.

We make every effort to display product colours and images accurately, but variations may occur depending on your device.

We may limit sales of products or services where legally permitted. All descriptions and pricing are subject to change before an order is placed.

Nothing in this section affects your statutory rights regarding goods that are faulty, misdescribed or not fit for purpose.

6. ACCURACY OF BILLING AND ACCOUNT INFORMATION

We may refuse or cancel an order before it is accepted, for example if a product is unavailable or an error is identified. A contract is formed only when we confirm dispatch.

You agree to provide accurate and current account information and to update it as necessary.

7. OPTIONAL TOOLS

We may provide access to third‑party tools. These are provided without warranties except those required by law. Your use of such tools is at your discretion and subject to the third party’s terms.

8. THIRD‑PARTY LINKS

Our site may contain links to third‑party websites. We are not responsible for their content or services. You should review their policies before engaging with them.

Nothing in this section limits liability that cannot be excluded under UK law.

9. USER COMMENTS AND SUBMISSIONS

If you submit comments, ideas or materials to us, you grant us permission to use them without restriction. You agree not to submit unlawful, defamatory, or infringing content.

We may remove content that breaches these Terms.

10. PERSONAL INFORMATION

Your submission of personal information is governed by our Privacy Policy.

11. ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be errors relating to product descriptions, pricing, promotions or availability. We may correct these and update information where required by law.

If an error affects your order, we will contact you before proceeding.

12. PROHIBITED USES

You must not use the site for unlawful, harmful, defamatory, discriminatory, or malicious purposes, or to interfere with the security or operation of the Service.

We may restrict access where legally permitted if you breach these Terms.

13. LIMITATION OF LIABILITY

Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot be limited under UK law.

We are responsible for supplying goods that are of satisfactory quality, fit for purpose and as described. If we fail to comply, you are entitled to the remedies set out in the Consumer Rights Act 2015.

We are not liable for losses that were not foreseeable when the contract was formed, or for business losses, as we supply goods for domestic use only.

We do not guarantee that the website will be uninterrupted or error‑free, but we will use reasonable care and skill in providing it.

If we fail to comply with these Terms, our liability is limited to the price you paid for the products, except where such limitation is not permitted by law.

14. INDEMNIFICATION

You agree to indemnify us only for losses arising from your unlawful misuse of the website or breach of intellectual property rights. This does not apply to normal consumer use of our products or services.

15. SEVERABILITY

If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect.

16. TERMINATION

These Terms remain in effect unless terminated by you or us. You may stop using the Service at any time.

We may terminate your access where legally permitted, for example in cases of fraud or breach of these Terms. Termination will not affect rights relating to orders already placed.

17. ENTIRE AGREEMENT

These Terms, together with our policies, constitute the entire agreement between you and us regarding your use of the Service.

18. GOVERNING LAW

These Terms are governed by the laws of England and Wales.

19. CHANGES TO TERMS

You can review the most current version of these Terms at any time on this page. Changes will apply only to future orders.

20. International Delivery

Customs Duties & Import Taxes: All orders dispatched from the UK to EU destinations are shipped on a DAP (Delivered At Place) basis unless otherwise stated. This means that import VAT, customs duties, and any carrier handling fees are not included in our prices and must be paid by the customer when the goods reach the destination country.

We have no control over these charges and cannot predict their amount. Failure to pay may result in delays, parcel return, or destruction by customs. Any costs arising from non‑payment are the customer’s responsibility.

  • Customs processing times vary and may delay delivery. These delays are outside our control.

  • We cannot mark orders as “gift” or undervalue goods to avoid customs charges.

  • Refused or unclaimed parcels returned to us will be refunded minus outbound shipping, return shipping, and any carrier fees.
